The Higher Administrative Court of North Rhine-Westphalia ruled in two judgments that North Rhine-Westphalian officials in financial hardship cases can claim aid for non-prescription, medically necessary drugs.

Two state officials had retired, suffering from a variety of illnesses, and large amounts in the years 2008 to 2010, among others. for drugs prescribed by their doctors but not available on prescription. They asserted that there was a hardship case against the defendant country and claimed aid if their expenses exceeded 1% of their respective previous year's income.

The state rejected the claims because the hardship case scheme claimed was not provided for under state aid law in North Rhine-Westphalia. In the first instance, the administrative court obliged the state to grant aid if the expenses for medically prescribed non-prescription medicines exceeded 2% of the respective previous year's income. The Higher Administrative Court now rejected the appeals lodged by the defendant country. (pm)
